Maximum Extent: Under no circumstances shall NxJournal, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages resulting from your use of or inability to use the Service, or for any loss of data or profits, even if we have been advised of the possibility of such damages.
Aggregate Liability Cap: In no event shall NxJournal’s total cumulative liability to you for any and all claims arising from or relating to these Terms or your use of the Service exceed the amount (if any) you have paid to NxJournal in the twelve (12) months immediately preceding the date the claim arose. Where no fees have been paid, NxJournal’s liability shall be zero.
